Effective July 1, 2003

Second units on land zoned A-1, R-1 and RVD provided following requirements are met:

  1. The lot is developed with one single family residence and its required parking.

  2. The applicant for the site plan review shall be the owner-occupant of the existing residence on the parcel. A covenant to this effect shall be recorded.

  3. Both the primary dwelling and the second unit shall remain permanently under one ownership. A covenant to this effect shall be recorded.

  4. The second unit shall be detached from the existing dwelling and shall have the same height limits as other accessory structures.

  5. Notwithstanding the floor area limits applicable to other accessory structures, the total area of floor space for a detached second unit shall not exceed 1,200 square feet or shall meet the minimum requirements of an efficiency unit (as defined in Sec 17958.1 of the Health & Safety code) whichever is greater.

  6. The proposed second unit and its associated accessory building(s) shall meet all current setback requirements. Only those accessory buildings, which are to the rear of all primary buildings, may extend into the required setback areas as described elsewhere in this section.

  7. The maximum floor area ratio (F.A.R) of all primary and accessory buildings and structures shall not exceed a ratio of 0.60 to 1.0.

  8. Parking for the second unit shall be one garage space for each bedroom, except when the proposed second unit is for an individual 62 years of age or older and the applicant agrees in a covenant with the City that the unit will only be occupied by someone of that age or older, the parking requirement may be satisfied by one unenclosed parking space.
